Contesting a Will

Heppenstalls offer a Fixed Fee service for assessing the merits of contesting a Will. For a fixed fee of £1200 (including VAT), we’ll complete an in-depth assessment of your case, and advise you if you have grounds for a claim or not.

There are several grounds for contesting a will including:

  • Lack of proper formalities
  • lack of testamentary capacity
  • lack of knowledge and approval
  • undue influence and fraud.

We will arrange a meeting with you to gather all the facts. We will then investigate the circumstances and if appropriate obtain the deceased’s medical records and review them, as well as speaking to any witnesses who can assist. It may be necessary to send a letter to the person who prepared the Will to ascertain the facts (a Larke v Nugus letter) and this is also included.

We will prepare a formal written assessment for your consideration and you can decide whether or not to proceed further.

Kerry qualified as a Solicitor in 2006 and joined Heppenstalls in 2018.

Kerry specialises in private client work and can advise on Will drafting, Lasting Powers of Attorney, Deputyship applications, Court of Protection matters and Probate and Estate administration. She is a committee member of Bournemouth District Law Society (BDLS) and also the chair of the BDLS Private client group.

Kerry also undertakes work in contentious probate and private client work. She is an associate member of ACTAPS (Association of Contentious Trust and Probate Specialists). She can advise on any dispute arising from the administration of an estate including contesting a Will, bringing an Inheritance (Provision for Family and Dependents) Act claim, Removal of Executors, Disputes between Beneficiaries.
